CCPA — California Consumer Privacy Act Policy

This California Consumer Privacy Act Policy (“CCPA Policy” or “Policy”) supplements our Privacy Policy and applies exclusively to California residents (“Consumers” or “you”) who access or use this website, utilize our services, and/or provide Personal Information to us through the website. This Policy is intended to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable California privacy laws. Unless otherwise defined in this Policy, capitalized terms have the meanings assigned to them under the CCPA. This Policy provides important information regarding our practices concerning the collection, use, disclosure, transfer, and sale of Personal Information relating to California Consumers who submit information through this website. It also explains the rights available to California Consumers under the CCPA and the procedures for exercising those rights. Only California residents, or their authorized registered designated agents acting on their behalf, may submit a CCPA request concerning a Consumer’s Personal Information. All requests are subject to applicable verification requirements. The website and its operators reserve the right to modify, amend, or replace this Policy at any time and for any reason—any changes will become effective immediately upon publication of the revised Policy and will supersede and replace all prior versions. Your continued use of the website following the posting of changes constitutes your acknowledgment and acceptance of the revised Policy.

1. Right to Know — Collection, Disclosure, and Sale of Personal Information

Consumers have the right to request information regarding the Personal Information we have collected, used, disclosed, or sold about them. A Consumer may submit a CCPA request by contacting us directly using the information provided in the “Contact Us” section below. Before responding to a request, we are required to reasonably verify the identity of the person submitting the request to ensure that the request relates to the individual whose Personal Information we maintain. For verification purposes, we may request limited information from the Consumer. Such information may include, but is not limited to: (1) full name; (2) physical address; (3) email address; and (4) last four digits of a Social Security number. The information requested for verification will be limited to information that the Consumer previously provided through the website, to the extent reasonably necessary to verify the Consumer’s identity. Once a request has been successfully verified, we will provide the Consumer with the information required by applicable law, which may include:

  • The categories of Personal Information we have collected about the Consumer;
  • The categories of sources from which the Personal Information was collected;
  • Our business or commercial purposes for collecting or selling the Personal Information; and
  • The categories of third parties with whom the Personal Information was shared or disclosed.

As described in our Privacy Policy, we may collect various types of information when Consumers access or use the website, including Personal Information, demographic information, behavioral information, and indirect information. Personal Information may be collected directly from Consumers, as well as indirectly through their use of and interactions with the website and our services, including when a Consumer submits a loan request form for the purpose of being connected with lenders or other financial service providers. In connection with providing these services, we may receive monetary compensation for disclosing or sharing (“passing”) Consumer Personal Information with third parties, including:

  • Affiliated entities;
  • Financial service providers;
  • Information or data aggregators; advertising networks;
  • Lenders, including tribal lenders; and
  • Advertisers.

The disclosure or sharing of Personal Information may occur for the following business or commercial purposes:

  • To assist Consumers in obtaining the financial services or short-term loan products they request through the website;
  • To permit third parties to market related products and services to Consumers;
  • To respond to and resolve Consumer inquiries, requests, or opt-out requests;
  • To maintain, improve, optimize, and enhance the website and its user experience;
  • To maintain the security and integrity of the website and its services; and
  • To respond to regulatory, governmental, or law enforcement inquiries or requests when required by applicable law.

For purposes of the CCPA, Personal Information does not include certain categories of information, including:

  • Publicly available information obtained from public or government records;
  • De-identified or aggregated Consumer information;
  • Information otherwise excluded from the scope of the CCPA; or
  • Personal Information governed by certain industry-specific privacy laws, including the Fair Credit Reporting Act (“FCRA”), the Gramm-Leach-Bliley Act (“GLBA”), and the California Financial Information Privacy Act (“FIPA”).

2. Right to Request Deletion of Personal Information

Consumers have the right, subject to certain exceptions and limitations under the CCPA, to request that we delete Personal Information that we have collected or maintained about them. To submit a deletion request, contact us at [email protected] and use the subject line “CCPA Right to Delete.”

After we verify the identity of the Consumer and process an otherwise valid deletion request, we will archive the Consumer’s Personal Information in a separate, secure, and encrypted database that is scheduled for destruction three (3) years from the date the Consumer originally provided the information to the website. Archived Personal Information will not be used for any purpose during the applicable retention period. We may be unable to immediately delete certain Personal Information where retention is necessary or required due to contractual or statutory obligations or prohibitions, including those arising under the Telephone Consumer Protection Act (“TCPA”), the CAN-SPAM Act of 2003 (“CAN-SPAM”), and California Business and Professions Code Section 17529.5.

3. Right to Opt-Out of the Sale or Sharing of Personal Information

Consumers have the right, subject to applicable law and exceptions, to opt out of the sale or sharing of their Personal Information by a business. By submitting a loan request through the website, a Consumer is requesting that we share or disclose the Consumer’s information with lenders and other third parties for the purpose of connecting the Consumer with a short-term loan or other financial service. Accordingly, the sharing of information necessary to fulfill the Consumer’s request may fall within an applicable exception to the statutory right to opt out. Nevertheless, if a Consumer submits a CCPA request to opt out of the sale or sharing of their Personal Information, we will honor the request and cease further sharing of the Consumer’s information to the extent required by applicable law. Consumers also have the right not to receive discriminatory treatment for exercising their rights under the CCPA. We do not discriminate against Consumers because they exercise their statutory privacy rights. We will not deny a Consumer services or provide a Consumer with a different quality or level of service solely because the Consumer submits a CCPA request. However, because our services principally involve sharing Consumer information with third parties in order to connect Consumers with financial products and services, exercising the right to opt out of the sharing or sale of Personal Information may prevent us from being able to provide those services to the Consumer.

4. Verification Requirements and Limitations

Consumers may submit no more than two (2) CCPA requests within a twelve (12)-month period for verification and processing. A “verifiable consumer request” must:

  • Provide sufficient information to enable us to reasonably verify the Consumer’s identity and confirm that the requesting individual is the person about whom we have collected Personal Information; and
  • Describe the request with sufficient detail to allow us to understand, evaluate, and respond appropriately to the request, including whether the Consumer is requesting to know, requesting deletion, or requesting to opt out of the sale or sharing of Personal Information.

For security and privacy purposes, we will not respond to a CCPA request that we are unable to reasonably verify. Any Personal Information provided by a Consumer in connection with a CCPA request will be used solely for purposes of verifying the identity of the requesting Consumer and processing the applicable request. In addition to the rights described above, California residents may have the right to request information regarding certain third parties to whom we have disclosed Personal Information for the third parties’ direct marketing purposes during the preceding calendar year. 5. Response to Consumer Requests

The operators of the website will respond to, and process verified Consumer requests within the time period required by applicable law, generally within forty-five (45) days after receipt of a verifiable consumer request. If additional time is reasonably necessary to process a request, we will provide the Consumer with written notice explaining the need for additional time and providing information regarding the status or disposition of the request, consistent with applicable law. Any such notice will generally be provided electronically using the email address or other contact information supplied by the Consumer in connection with the request.
